Acceptable Use Policy

This policy is part of the Terms of Service. It says what you may and may not do with the service. The short version: send to people you have a right to contact, say who you are, let them stop you, and do not use the service to hurt anyone.

1. You are the sender

Every message the service sends leaves through a mailbox you connect and control. You are the sender of record. The message, its recipients, and its compliance with the law are your responsibility, in every country the message reaches. That includes the CAN-SPAM Act in the United States, CASL in Canada, PECR and the GDPR in the United Kingdom and the European Union, and any law that applies where your recipient sits.

2. Who you may contact

You may contact people you have a lawful basis to contact: a business relationship, a prior inquiry, a public business role that makes the contact reasonable, or consent.

You may not send to lists that were purchased, rented, traded, harvested, or scraped, from any source, for any price. It does not matter whether the seller says the list is opted in.

You may not send to an address that has asked you, or anyone in your organization, to stop.

3. What every message must carry

Every message must identify you and your organization truthfully, use a subject line that is not misleading, carry a real reply address that a person reads, and give the recipient a way to stop receiving your email. A request to stop must be honored at once and across your whole organization, not just by the person who received it.

4. Sending behavior

Do not send more than your mailbox provider allows. Do not rotate mailboxes, domains, or identities to get around limits or blocks. Do not use the service to warm up mailboxes with artificial engagement. Do not spoof a sender, a domain, or a reply address. Do not send the same message to many recipients as if it were a personal note.

If your sending draws complaints, bounces, or blocks at a rate that threatens the service or other customers, we may pause sending for your account and tell you why. We will lift the pause when the cause is fixed.

5. Content you may not send

No message may be unlawful, defamatory, threatening, harassing, discriminatory, sexually explicit, or deceptive. No message may promote fraud, pyramid schemes, counterfeit goods, weapons, controlled substances, or anything illegal where it is sent. No message may impersonate a person, a company, or a government.

6. Drafts

The service writes drafts and researches accounts. You read a draft before you send it, and you are responsible for it once it goes. Do not send a draft you have not read. Do not present research as fact to a recipient without checking it.

7. The service itself

You may not probe, scan, overload, or attempt to break into the service or its infrastructure. You may not scrape it, copy it, reverse engineer it, or use automated tools against it beyond what its own features provide. You may not use the service, its methodology, its industry knowledge, or its output to build, train, or improve a competing product. You may not share a sign-in, sell access, or let anyone outside your organization use your account.

8. Other people's data

Put into the service only data you have the right to hold. Do not upload data you are not allowed to process, and do not use the service to process data of children under 16.

9. What happens when this policy is broken

We may pause sending, suspend an account, or terminate it, depending on how serious the breach is and whether it repeats. Where we can, we will tell you first and give you a chance to fix it. For unlawful sending, impersonation, or a risk to other customers or to the service, we may act at once. Fees already paid are not refunded when an account is suspended or terminated under this policy.

10. Reporting

If you receive email through the service that you believe breaks this policy, or you believe an account is being misused, write to info@ruthlessaicrm.net with the message and its headers.
